Econ Development Week Giveaway

ELIGIBILITY: The Bannock Development Corporation (BDC) EconDev Giveaway is open only to entrants  who are legal residents of Idaho, residents of the Portneuf Valley area, 21 years of age or older as of  the date of entry. The following persons are not eligible to enter or win: employees of BDC or the  immediate family members (e.g., the spouse, parents, siblings, and/or children and their respective  spouses, regardless of where they reside) and any other members of such households, whether or not  related, of any employee of BDC. The giveaway is subject to all applicable federal, state and local laws.  

DRAWING: Entries must be received during the Entry Period to be eligible for the drawing. Two (2) potential winner will be drawn at random on or about Friday, May 15, 2025, from among all eligible entries received. Sponsor reserves the right to delay the drawing. The potential winner will be notified  via email and/or telephone (in BDC’s discretion). The potential winners must response to such notification  within twenty-four (24) hours, or he/she will forfeit the prizes (as defined below) and, at BDC’s sole  

discretion and time permitting, and an alternative potential winner will be drawn at random from  among all remaining eligible entries. The potential winners will be required to execute and return, prior  to and as a condition of receiving the prizes, an affidavit of eligibility and liability release and, except where  prohibited by law, a publicity release. The potential winners must return such releases within two (2) days  of date of issuance. Failure to comply with these Official Rules will cause the prizes to be forfeited  and, at BDC’s sole discretion and time permitting, awarded to an alternate potential winner to be randomly  drawn from among all remaining eligible entries. Odds of winning the prizes depend on the number of  eligible entries received for the drawing. If (i) the potential winners do not respond to the prize  notification within the time-frame stated, (ii) the prize notification is returned as undeliverable, (iii) the  potential winners declines his or her prizes, or (iv) the potential winners fails to return all required  documents within the time-frame stated, it will result in Prize forfeiture and the disqualification of such  potential winner and, at BDC’s sole discretion and time permitting, an alternate potential winner may be  drawn by random drawing from among all remaining eligible entries. 

DESCRIPTION OF PRIZE(S): Two (2) prizes (hereinafter, the “Prize”): One (1) winner will receive one (1) 

Blackstone Grill with Blackstone Grilling accessories. The other winner (1) will receive one will receive  one (1) Coleman Tent and (1) igloo cooler. The Approximate Retail Value (“ARV”) of the first prize is  estimated at $432.99. The ARV of the second prize is estimated at $214.96. Specific dates are at  the sole discretion of BDC and subject to limitations and special conditions. No prize substitutions  will be permitted, except in BDC’s sole discretion. The prizes are awarded “as is” with no warranty  or guarantee, either express or implied by BDC. The prizes is not transferrable, and no substitutions or  cash redemptions are allowed, except by BDC who reserves the right to substitute the prizes (or any  component thereof) with one of comparable or greater retail value in their sole discretion. Resale  of the prizes or any portion of the prizes is prohibited. All costs and expenses not stated herein as  being provided in connection with the redemption, receipt and/or use of the prizes are the  responsibility of the winner, including, but not limited to, transportation, accommodations, and all  federal, state and local taxes. All Prize details are at BDC’s sole discretion.  

ADDITIONAL TERMS: By entering, each entrant agrees to abide and be bound by these Official Rules and  the decisions of BDC, which are final and binding in all matters relating to this Sweepstakes. Entries will be  declared made by the authorized account holder of the email address submitted at the time of entry  and he/she must comply with these Official Rules. “Authorized account holder” is defined as the  natural person who is assigned to an email address by an Internet access provider, online service  provider or other organization (e.g., business, education, institution, etc.) responsible for assigning email  addresses for the domain associated with the submitted email address. Released Parties (as defined  below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, illegible, undelivered  or garbled entries or email; or for entries not received due to lost, failed, delayed or interrupted  connections, including Internet Service Provider (ISP), Web-server, network, cable, server, satellite, phone line connections or miscommunications, or other electronic malfunctions, computer or telephone,  hardware or software failures, malfunctions, or garbled or jumbled transmissions. Released Parties are not  responsible for any other errors or difficulties of any kind whether human, mechanical, electronic,  computer, network, typographical, printing or otherwise relating to or in connection with the giveaway,  including, without limitation, errors or difficulties which may occur in connection with the  administration of the giveaway, the processing of entries, the announcement of the prize, the  cancellation or postponement of any event or in any giveaway-related materials. Released Parties  are also not responsible for any incorrect or inaccurate information, whether caused by site users,  tampering, hacking, or by any equipment or programming associated with or utilized in the giveaway.  Released Parties are not responsible for injury or damage to entrant’s or to any other person’s computer  related to or resulting from participating in this giveaway or downloading materials from or use of the  website or for any travel related delays or cancellations (if applicable). Persons who tamper with or  abuse any aspect of the giveaway or website or who are in violation of these Official Rules, as solely  determined by BDC, will be disqualified and all associated entries will be void. BDC reserve the right,  in its sole discretion, to cancel or suspend the giveaway should virus, bugs, unauthorized human  intervention, or other causes, in BDC’s sole opinion, corrupt or impair the administration, security,  fairness or proper operation or play of the giveaway, and, in the event of termination, draw the  winner from all non-suspect, eligible entries received prior to action taken. All entries become the  property of BDC and will not be returned. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY  DAMAGE ANY WEBSITE ASSOCIATED WITH THIS GIVEAWAY OR UNDERMINE THE LEGITIMATE OPERATION  OF THIS GIVEAWAY AY BE A VIOLATION OF CRIMINIAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT  BE MADE, BDC AND/OR THEIR AGENTS RESERVE THE RIGHT TO DISQUALIFY AND SEEK DAMAGES AND  OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE 

ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If due to a printing, production or other error,  more prizes are claimed than are intended to be awarded, the intended prizes will be awarded in a  random drawing from among all verified and validated prize claims received. No more than the stated  number of Prize(s) will be awarded. 

WINNER’S LIST: For the names of the winners (available after May 14, 2025), send a self-addressed  envelope, along with your request, to: 1001 N 7TH AVE., Ste. 250, POCATELLO, ID 83201. Such request  must be received prior to May 19, 2025. 

PUBLICITY: The winner acknowledges and agrees that as a condition of winning, if legally permissible,  BDC and their designees have the right to use his/her name, likeness, photograph, voice, city and  state of residence and prize information for advertising and promotional purposes in any and all  media now known or hereafter devised, worldwide in perpetuity, without further compensation,  authorization, remuneration or notification.  

TAXES: All applicable local, state and federal taxes are the sole responsibility of the winner. 

LIABILITY: Each entrant, by entering the giveaway, agrees that the giveaway Parties and each of their  applicable parents, affiliates and subsidiaries, will have no liability whatsoever for and shall be held  harmless by entrants against, any injuries, losses or damages of any kind, including death, to  persons, or property incurred in connection with, or resulting, in whole or in part, directly or indirectly  from acceptance, possession or use/misuse of the Prize (including any travel or activity related  thereto) and/or participating in this giveaway.  

Sponsor Contesting Platform Terms and Conditions:  

BDC will conduct all BDC contests, including on-air contests, online and text-based contests and  contests conducted through BDC’s social media accounts (e.g., Facebook, Twitter, etc.), substantially as  described in these rules, and by participating, each participant agrees as follows:  

1. Unless otherwise specified, all contests are open to only legal US residents 21 years of age or older who reside in Bannock County, Idaho. Residency must be proven by producing, upon request, a valid, legal United States photo ID issued by Idaho. 
2. Contest winners who have won any prizes from BDC within thirty (30) days of entry, or have won any prize from the same contest are not eligible. Only one entry per person is permitted. 
3. Prizes may not be transferred, substituted or redeemed for cash, except that BDC reserves the right to substitute prizes of equal or greater value in its sole discretion. 
4. Prizes must be picked up from BDC’s office (1001 N 7TH AVE, STE. 250, POCATELLO, ID 83201) for  redemption. 

HOW TO ENTER: 

On-Line Entry: BDC is not responsible for failed, partial or garbled computer transmission, service outages  or for technical failures of any kind, including but not limited to electronic malfunction or damage of any  network, hardware or software. If for any reason the contest is not capable of running as planned, 

including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical  failures, other causes beyond BDC’s control that corrupt or affect the administration, security, fairness,  integrity or proper conduct of the contest, BDC reserves the right, in its sole discretion, to disqualify any  individual who tampers with the entry process, and to cancel, terminate, modify or suspend the  contest. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in  operation or transmission, communications line failure, theft or destruction or unauthorized access to,  or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any electronic  entry to be received on accord on account of technical problems or traffic congestion on the Internet  or at any Website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulted from participation in or downloading any materials from  this contest. In the event of a dispute over an electronic entry, prizes will be awarded to that name on  the entry form, not the owner of the email account. Internet entries will be deemed made by the  authorized account holder of the e-mail address submitted at the time of entry. The authorized  account holder is the natural person who is assigned to the e-mail address by an internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the  domain associated with the submitted e-mail address. 

Contestants will not be considered “winners” until all required information has been received. If for  some reason a disconnection of the Internet takes place before we receive all of the required  information, BDC the right to choose another contestant. Winners are solely responsible for all federal,  state, and local taxes if any. No purchase necessary. Void where prohibited. All federal, state, and local  regulations apply. Some restrictions apply.  

Decisions of BDC are final. Such decisions may include, but are not limited to, whether an entry adheres  to the entry criteria, the time of entry receipt by BDC, the order in which entries are received, the  eligibility of the entrant, and, the submission of an answer or response. BDC, in its sole discretion,  reserves the right to disqualify any person tampering with the entry process or who is otherwise in  violation of the rules. If BDC determines that any entry contains false, misleading or fraudulent  information, such entry will be disqualified. Failure to comply with the contest rules may result in a  contestant’s disqualification.  

Winners may be required to show proof of age and identity and may be required to execute BDC’s  Photogenic Release allowing BDC to use his/her name and likeness for publicity and releasing BDC from  any liability in connection with acceptance and use of the prize, within the time period specified by BDC.  By participating in the contest, the winners (and their guest or traveling companion, if applicable) agree  to have their name, voice, or likeness used in any advertising or broadcasting material relating to this  contest without additional financial or other compensation, and to sign a publicity release prior to  acceptance of the prize.  

Odds of winning are dependent on the number of qualifying entries received.  

In the event the prize winners have not fulfilled his/her obligations to receive the prize, the prize may be  forfeited, and an alternate winner may be selected at random from all eligible entries BDC reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason. Material  modifications shall be announced on-air, when practical. By participating in this contest, entrants agree to  be bound by these rules, any modifications thereof, and by all other rules imposed by BDC. If due to 

circumstances beyond the control of BDC, any event associated with the contest or the prize is  delayed, rescheduled, postponed or cancelled, BDC reserves the right, but not the obligation,  to cancel or modify the contest and shall not be required to award a substitute prize.  

Randomly selected winners will be randomly selected from all of our eligible qualifying entries.  Before awarding prize winners their prize, the winners will be required to show proof of age, identity and residency and to execute a Photogenic Release specifying, among other things, that BDC may use their names, voices and likenesses for publicity and promotional purposes in any and all media worldwide in perpetuity and releasing BDC and their respective officers, directors,  employees, agents and representatives from any liability or expense arising from or relating to  participation in the giveaway and/or acceptance or use of any prize. The Photogenic Release must be  signed and returned within 10 days of receipt or winner will be disqualified.  

PUBLICITY: Except where prohibited, participation in a Contest constitutes winner’s consent to BDC and  its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for  promotional purposes in any media, worldwide, without further payment or consideration, unless  otherwise prohibited by law.  

Taxes: All State, Local, Federal, and or other, duties, tariffs, title fees, licensing fees, or other fees for  prizes awarded in any Contest become the sole responsibility of the winner. All those who win a prize or  prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings  

General Conditions: BDC reserves the right to cancel, suspend and/or modify any giveaway, or any part of  it, if any fraud, technical failures or any other factor beyond BDC’s reasonable control impairs  the integrity or proper functioning of the giveaway, as determined by BDC in its sole discretion.  BDC reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the  entry process or the operation of the giveaway or to be acting in violation of these Official Rules or any  other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to  deliberately undermine the legitimate operation of a Contest may be a violation of criminal and civil law,  and, should such an attempt be made, BDC reserves the right to seek damages from any such person to  the fullest extent permitted by law. BDC’s failure to enforce any term of these Official Rules shall not  constitute a waiver of that provision.  

Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate  information, whether caused by entrants, printing errors or by any of the equipment or programming  associated with or utilized in the giveaway; (2) technical failures of any kind, including but not limited to  malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3)  unauthorized human intervention in any part of the entry process or the giveaway; (4) technical or  human error which may occur in the administration of the giveaway or the processing of entries; or (5)  any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in  part, from entrant’s participation in the giveaway or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the giveaway, provided that if it is not  possible to award another entry due to discontinuance or completion of the giveaway, or any part of it,  for any reason, BDC, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the

stated number of prizes will be awarded. In event that production, technical, programming or any other  reason causes more than stated number of prizes as set forth in these Official Rules to be available or  claimed, BDC reserves the right to award only the stated number of prizes by a random drawing among  all legitimate, unawarded, eligible prize claims. Entrees and winners acknowledge that if they enter  any giveaway under a false, fictitious, or fraudulent name, address, phone number, ID number  or Social Security number, they will be automatically disqualified from this contest and any future  contests on BDC. If a winner cannot pick up the prize, the prize will be forfeited.  

BDC is not responsible for typographical or other errors in the printing, the offering or the  administration of the contest or in the announcement of a prize. Prizes awarded are limited solely to  those items explicitly set forth as being part of the prize and shall not include any and all other  expenses, incidentals or taxes that may arise out of the winner’s receipt of this prize. Prizes will be  awarded as is, with no written or express warranty.
